Pump.fun (including, without limitation, all persons and entities who are responsible for the ownership, maintenance, development and upkeep of the web interface located at pump.fun, any mobile applications associated with pump.fun and all smart contracts which may be interacted with through the pump.fun web or mobile interface) integrates the Donate.gg platform ("Donate.gg") via its developer API to facilitate charitable donations of creator fees for tokens launched using pump.fun. More information about creator fees can be found here. Donate.gg enables users to make donations in cryptocurrency to verified nonprofit organizations, which may be converted into fiat currency and distributed to the selected charities.

Pump.fun does not directly process, custody, or control any donation funds. All donations are routed, processed, and fulfilled through Donate.gg and its underlying infrastructure.

Pump.fun does not solicit charitable contributions on behalf of any charity or nonprofit organization and does not act as a "professional fundraiser," "fundraising counsel," "commercial co-venturer," or similar intermediary under any applicable federal, state, local, or non-U.S. law governing charitable solicitations, fundraising activities, or charitable promotions.

Pump.fun's role is strictly limited to providing a technical interface that enables users, at their own initiative and discretion, to direct certain creator fees to Donate.gg. Pump.fun does not request, encourage, promote, or induce any user to make a donation, and any decision to route creator fees or make a donation is made solely by the user.

Pump.fun does not advertise or promote any specific charity or charitable campaign, represent that any donation will be used for any particular purpose, guarantee that any charity will receive or use funds in any specific manner, or receive, control, possess, or benefit from any donated funds.

To the extent that any applicable law in any jurisdiction (including, without limitation, the U.S. states of New York, California, New Jersey, Massachusetts, Illinois, or any other jurisdiction with charitable solicitation laws) could be interpreted to apply to Pump.fun's provision of the donation-related interface described herein, Pump.fun expressly disclaims any status or role that would subject it to registration, reporting, bonding, disclosure, or other regulatory requirements applicable to charitable solicitors, professional fundraisers, commercial co-venturers, or similar regulated persons.

Users acknowledge and agree that:

• (a) any donation or routing of creator fees is made voluntarily and at the user's sole direction;
• (b) Pump.fun does not provide any representation regarding the charitable status, tax-exempt status, or regulatory compliance of any organization available through Donate.gg;
• (c) any required disclosures, acknowledgments, or receipts in connection with a donation are the sole responsibility of Donate.gg and/or the applicable charity; and
• (d) users are solely responsible for determining whether any donation complies with applicable charitable solicitation laws, disclosure requirements, or other legal obligations in their jurisdiction.

Nothing in this disclaimer or in Pump.fun's services shall be deemed to constitute a charitable solicitation, advertisement, or fundraising activity by Pump.fun under any applicable law.

2. No Financial, Tax, or Legal Advice

Pump.fun only facilitates the routing of creator fees to donate.gg. Pump.fun does not provide financial, investment, tax, or legal advice.

Users are solely responsible for determining the tax implications of donations routed through donate.gg. Users are responsible for complying with applicable laws and regulations in their jurisdiction. Users must consult with qualified professionals regarding any financial or tax matters relating to donations routed through donate.gg.

Pump.fun makes no representations or warranties regarding the tax treatment, tax consequences, or availability of any deduction, credit, exemption, or other tax benefit in connection with any donation or routing of creator fees to Donate.gg. The tax treatment of any such donation will depend on each user's particular facts and circumstances, including such user's jurisdiction, tax status, and individual tax position, none of which is known to or evaluated by Pump.fun. Pump.fun has no information regarding any user's unique tax situation and disclaims any responsibility for determining or advising on the tax treatment of any donation routed to Donate.gg.

Pump.fun is not a charitable solicitor, professional fundraiser, or commercial co-venturer under any applicable law, and does not solicit donations on behalf of any charity.

3. Third-Party Platform and Charities

All donation functionality is powered by Donate.gg, a third-party service. Pump.fun does not verify or audit the charities listed on Donate.gg. Donate.gg solely controls the selection, of any nonprofit organizations or charities which may receive donations, and pump.fun does not review or select and organizations selected by Donate.gg. Pump.fun does not guarantee that any donation qualifies for tax deductions in any jurisdiction. Pump.fun does not endorse, recommend, or promote any charity or nonprofit organization made available through Donate.gg.

Donate.gg maintains its own network of verified charities and routes donations according to user-selected configurations. In order for any user to claim charitable deductions or derive other financial or tax benefits from donations made through donate.gg, such users may need to provide personal information to donate.gg.

Pump.fun is not responsible or liable for any personal information, personally identifiable information, or other data that any user provides directly to Donate.gg, including in connection with seeking donation receipts, tax documentation, or any charitable deduction or other financial or tax benefit. Any collection, use, storage, disclosure, transfer, processing, security, or handling of such information is solely governed by Donate.gg's terms, policies, and practices, and is undertaken at the user's own risk. The information which pump.fun collects about its user is available here, and the donate.gg integration does not change this information.

All fees which are routed from pump.fun to donate.gg are denominated in the solana token. Donate.gg is solely responsible for the conversion of the solana token to a currency which the charity will accept. Donate.gg charges a fee for its service. No portion of the fee charged by Donate.gg accrues to pump.fun. Any issues related to donation processing, charity legitimacy, fund distribution, or conversion and off-ramping of tokens or digital assets to charities must be directed to Donate.gg or the relevant charity.

4. Donation Processing and Cryptocurrency Risks

Donations made through Donate.gg using Pump.fun involve cryptocurrency transactions, which carry inherent risks, including, without limitation, price volatility prior to conversion, network delays or failures, irreversibility of transactions, and smart contract or blockchain-related risks. By making a donation, you acknowledge and accept these risks. ALL TRANSACTIONS ARE FINAL AND NON-REVERSIBLE, AND NO REFUNDS WILL BE PROVIDED.

5. No Custody or Control of Funds

Pump.fun does not take custody of, hold, possess, receive, access, escrow, control, or transmit any user funds, digital assets, private keys, seed phrases, or wallet credentials at any time in connection with the donation functionality described in this disclaimer. Donations are executed through Donate.gg's infrastructure, including its API, smart contracts, routing mechanisms, and related on-chain and off-chain processes, and any transfer of digital assets occurs directly through such third-party systems and the applicable blockchain network.

Pump.fun does not act as an intermediary, agent, broker, custodian, trustee, escrow provider, money transmitter, payment processor, or financial institution with respect to any donation, creator fee routing, digital asset transfer, conversion, off-ramp, settlement, or distribution to any charity or nonprofit organization. Pump.fun does not initiate, control, supervise, reverse, stop, recover, or guarantee any transaction and has no authority over the receipt, custody, exchange, conversion, safeguarding, or disbursement of any donated amounts.

Once creator fees or other amounts are routed to Donate.gg or submitted to the applicable blockchain network, Pump.fun has no ability to access, reclaim, redirect, freeze, reverse, or otherwise affect such funds or assets. Pump.fun is not responsible for any transaction failure, delay, loss, misdirection, erroneous transfer, slippage, pricing discrepancy, off-ramp issue, conversion issue, wallet error, smart contract issue, validator or network issue, or any other problem arising from or relating to the movement, processing, conversion, settlement, or distribution of donation funds.

Users acknowledge and agree that Pump.fun's role is limited solely to making available an interface that may facilitate routing creator fees to Donate.gg, and that all donation processing, transaction execution, asset conversion, custody-related functions, and fund distribution are performed exclusively by Donate.gg and/or other third-party infrastructure providers. Accordingly, Pump.fun disclaims any and all liability arising out of or relating to the custody, control, transmission, processing, conversion, settlement, delivery, or non-delivery of any donation funds or digital assets.

6. Accuracy of Information

While Pump.fun may make available certain information regarding the Donate.gg integration, donation routing functionality, nonprofit organizations, creator fee routing, digital asset conversions, receipts, tax-related materials, or other related content through the Pump.fun website, mobile applications, or any associated interfaces, Pump.fun does not represent or warrant that any such information is current, complete, accurate, reliable, available, suitable, or error-free.

Without limiting the foregoing, Pump.fun makes no representations or warranties regarding:

1. the completeness, accuracy, legality, status, qualification, tax treatment, or continued eligibility of any charity, nonprofit organization, or charitable program displayed, referenced, or made available through Donate.gg or through any Pump.fun interface;
2. the availability, operability, security, performance, functionality, compatibility, or uninterrupted operation of Donate.gg, the Donate.gg API, any associated smart contracts, blockchain networks, third-party wallets, conversion services, off-ramp providers, or any related third-party infrastructure;
3. the successful initiation, routing, processing, conversion, settlement, receipt, delivery, timing, valuation, or final distribution of any creator fees, donations, digital assets, or proceeds to any intended charity or nonprofit organization;
4. the accuracy, availability, issuance, timeliness, or legal sufficiency of any confirmations, donation records, receipts, acknowledgments, tax forms, tax documentation, or other materials that may be provided by Donate.gg, any charity, or any other third party; or
5. the availability, accessibility, continued support, or proper functioning of any feature on Pump.fun that references, links to, or facilitates routing creator fees to Donate.gg.

Any information presented by Pump.fun in connection with the donation functionality is provided solely for general informational convenience and may be based on information obtained from Donate.gg or other third parties that Pump.fun does not independently verify, audit, monitor, or update. Users are solely responsible for independently reviewing and evaluating all relevant information before relying on it or taking any action in connection with any donation or creator fee routing decision.

The Donate.gg API and related donation functionality may be in beta, experimental, unavailable, delayed, modified, suspended, discontinued, or subject to technical errors or changes at any time, with or without notice. Pump.fun shall have no liability or responsibility for any inaccuracy, omission, display error, outdated information, interruption, or failure relating to any information, content, or functionality made available in connection with the Donate.gg integration.

7. International Use

The donation functionality described in this disclaimer may be made available to users in multiple jurisdictions, and users in any jurisdiction (who otherwise permitted to use the pump.fun platform) may elect to direct creator fees to charitable organizations or nonprofit organizations through Donate.gg, subject to the availability of Donate.gg, the applicable blockchain network, and any applicable third-party services. The availability of the features described herein do not expand or limit the jurisdictions in which Pump.fun may be accessed or used. Pump.fun does not restrict or tailor the availability of such functionality based on any particular jurisdiction and does not undertake to determine whether directing creator fees to Donate.gg, making donations in digital assets, interacting with any related smart contracts or blockchain networks, or using any related features is permitted, appropriate, or effective under the laws, rules, or regulations of any country, state, province, territory, or other jurisdiction.

Users are solely responsible for ensuring that their access to and use of the website, mobile applications, donation functionality, Donate.gg integration, and any direction of creator fees to charities or nonprofit organizations through Donate.gg complies with all laws, regulations, rules, orders, and legal requirements applicable to such user, including, without limitation, those relating to charitable solicitation, charitable giving, digital assets, cryptocurrency transactions, taxation, reporting, disclosures, registration, licensing, consumer protection, anti-money laundering (AML), counter-terrorism financing (CTF), sanctions, export controls, and cross-border transfers. Users represent and warrant that they are not located in, organized under the laws of, or ordinarily resident in Cuba, Iran, North Korea, Syria, Russia, Belarus, or the Crimea, Donetsk People's Republic, and Luhansk People's Republic regions of Ukraine, or the United Kingdom, and are not listed on any applicable sanctions lists (including the OFAC SDN List).

Pump.fun makes no representation, warranty, or covenant that the website, mobile applications, Donate.gg integration, donation functionality, routing of creator fees, or any related services, content, features, or materials are available, appropriate, compliant, lawful, permitted, suitable, or fit for use in any jurisdiction. Without limiting the foregoing, Pump.fun makes no representation or warranty that any donation, direction of creator fees, interaction with Donate.gg, or use of any related functionality will satisfy the legal, regulatory, tax, operational, technical, or compliance requirements of any jurisdiction or of any user located in, resident in, organized in, or subject to the laws of any jurisdiction.

Users access and use the donation functionality and direct creator fees to Donate.gg at their own initiative and entirely at their own risk. Pump.fun disclaims any and all responsibility and liability arising out of or relating to any user's use of the donation functionality in any jurisdiction, including any claim that such use, donation, routing, transfer, conversion, or related activity is unavailable, restricted, unlawful, non-compliant, ineffective, or unsuitable in such jurisdiction.

8. Fees and Charges

Donate.gg may charge fees in connection with its services, including, without limitation, fees relating to donation processing, digital asset conversion, off-ramping, routing, settlement, or other related services. Pump.fun does not determine, set, impose, receive, retain, monitor, verify, or control any fees, costs, spreads, exchange rates, commissions, deductions, or other charges that may be applied by Donate.gg or any of its service providers, partners, or underlying infrastructure.

Any fees, costs, deductions, exchange rate spreads, or other charges associated with donations routed through Donate.gg are solely determined by Donate.gg and/or the applicable third parties involved in processing, converting, settling, or distributing the donation. Pump.fun has no knowledge of the amount, calculation, timing, application, accuracy, reasonableness, or disclosure of any such fees or charges and makes no representation, warranty, or guarantee that any particular portion of any donation will be received by any charity or nonprofit organization.

Users are solely responsible for reviewing any terms, disclosures, fee schedules, exchange rates, and other information made available by Donate.gg or any relevant third party and for determining whether to proceed with any donation or creator fee routing in light of any applicable fees or charges. Pump.fun disclaims any and all liability arising out of or relating to any fees, costs, deductions, spreads, exchange rates, or other charges imposed by Donate.gg or any third party in connection with any donation.

9. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PUMP.FUN, INCLUDING, WITHOUT LIMITATION, ITS OWNERS, OPERATORS, DEVELOPERS, AFFILIATES, LICENSORS, SERVICE PROVIDERS, PERSONNEL, AGENTS, REPRESENTATIVES, SUCCESSORS, AND ASSIGNS, SHALL NOT BE LIABLE FOR ANY CLAIM, LOSS, DAMAGE, LIABILITY, COST, OR EXPENSE OF ANY KIND ARISING OUT OF OR RELATING TO THE DONATE.GG INTEGRATION, THE DONATION FUNCTIONALITY, THE ROUTING OF CREATOR FEES, ANY DIGITAL ASSET TRANSACTION, OR ANY USER'S ACCESS TO, USE OF, OR INABILITY TO USE ANY OF THE FOREGOING, WHETHER IN CONTRACT, TORT, STRICT LIABILITY, STATUTE, OR ANY OTHER LEGAL OR EQUITABLE THEORY, AND WHETHER OR NOT PUMP.FUN HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH CLAIM, LOSS, DAMAGE, LIABILITY, COST, OR EXPENSE.

WITHOUT LIMITING THE FOREGOING, PUMP.FUN SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, ENHANCED, PUNITIVE, OR OTHER DAMAGES, OR FOR ANY LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF BUSINESS, LOSS OF OPPORTUNITY, LOSS OF GOODWILL, LOSS OF DATA, LOSS OF USE, DIMINUTION IN VALUE, BUSINESS INTERRUPTION, TRADING LOSSES, LOSS RESULTING FROM PRICE VOLATILITY, OR COST OF PROCUREMENT OF SUBSTITUTE SERVICES, ARISING OUT OF OR RELATING TO ANY DONATION, FAILED DONATION, DELAYED DONATION, MISDIRECTED DONATION, TRANSACTION ERROR, SMART CONTRACT FAILURE, BLOCKCHAIN FAILURE, NETWORK CONGESTION, WALLET ERROR, DIGITAL ASSET CONVERSION, OFF-RAMP FAILURE, CHARITY DISTRIBUTION ISSUE, TAX CONSEQUENCE, OR ANY ACT, OMISSION, ERROR, OR FAILURE OF DONATE.GG, ANY CHARITY, ANY NONPROFIT ORGANIZATION, ANY BLOCKCHAIN NETWORK, OR ANY OTHER THIRD PARTY.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PUMP.FUN DISCLAIMS ANY AND ALL LIABILITY ARISING OUT OF OR RELATING TO THE SELECTION, VERIFICATION, STATUS, LEGITIMACY, QUALIFICATION, CONDUCT, ACTS, OMISSIONS, RECEIPT OF FUNDS, USE OF FUNDS, OR TAX TREATMENT OF ANY CHARITY OR NONPROFIT ORGANIZATION, AS WELL AS ANY LIABILITY ARISING FROM ANY INACCURACY, INTERRUPTION, UNAVAILABILITY, OUTDATED INFORMATION, SECURITY INCIDENT, OR OTHER FAILURE OF DONATE.GG, ITS API, ANY ASSOCIATED SMART CONTRACTS, ANY DIGITAL ASSET INFRASTRUCTURE, OR ANY RELATED THIRD-PARTY SERVICE OR PROVIDER.

IN NO EVENT SHALL PUMP.FUN'S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SUBJECT MATTER OF THIS DISCLAIMER, THE DONATE.GG INTEGRATION, OR THE DONATION FUNCTIONALITY EXCEED U.S. $100.00, TO THE EXTENT SUCH LIMITATION IS PERMITTED BY APPLICABLE LAW. THE FOREGOING LIMITATIONS, EXCLUSIONS, AND DISCLAIMERS OF LIABILITY SHALL APPLY EVEN IF ANY REMEDY FAILS OF ITS ESSENTIAL PURPOSE AND REGARDLESS OF THE FORM OF ACTION.

YOUR ACCESS TO AND USE OF THE DONATION FUNCTIONALITY, THE ROUTING OF CREATOR FEES TO DONATE.GG, AND ANY RELATED DIGITAL ASSET TRANSACTION OR INTERACTION WITH DONATE.GG IS ENTIRELY AT YOUR OWN RISK. YOU ACKNOWLEDGE AND AGREE THAT PUMP.FUN'S ROLE IS LIMITED, THAT PUMP.FUN DOES NOT CUSTODY OR CONTROL DONATION FUNDS, AND THAT YOU ARE SOLELY RESPONSIBLE FOR EVALUATING WHETHER TO USE THE DONATION FUNCTIONALITY AND FOR BEARING ALL RISKS ASSOCIATED WITH SUCH USE.

10. Indemnification

To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Pump.fun, including, without limitation, its owners, operators, developers, affiliates, licensors, service providers, personnel, agents, representatives, successors, and assigns, from and against any and all claims, demands, actions, causes of action, proceedings, investigations, liabilities, damages, judgments, awards, losses, costs, fines, penalties, and expenses of any kind or nature whatsoever, including reasonable attorneys' fees and legal costs, arising out of or relating to: (a) your access to or use of the donation functionality, the Donate.gg integration, or any related website, mobile application, interface, smart contract, blockchain interaction, or digital asset transaction; (b) your direction or routing of creator fees to Donate.gg or to any charity or nonprofit organization through Donate.gg; (c) your violation of this disclaimer or any applicable law, rule, regulation, order, or the rights of any third party; (d) any information, materials, instructions, wallet details, tax information, personal information, or other content you provide in connection with any donation or attempted donation; or (e) any dispute, claim, or controversy between you and Donate.gg, any charity, any nonprofit organization, any governmental authority, or any other third party in connection with the donation functionality.

Without limiting the foregoing, you agree to indemnify, defend, and hold harmless Pump.fun from and against any and all claims arising out of or relating to any donation, failed donation, delayed donation, misdirected donation, refund request, chargeback, reversal request, tax claim, regulatory inquiry, enforcement action, investigation, allegation of unlawful charitable solicitation or contribution, sanctions issue, anti-money laundering or counter-terrorism financing issue, disclosure or reporting obligation, or any other matter resulting from or connected with your use of Donate.gg, your use of the donation functionality, your transfer of digital assets, your interactions with any charity or nonprofit organization, or your failure to comply with applicable legal or regulatory requirements.

Pump.fun reserves the right, at your expense, to assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate fully, at your own expense, with Pump.fun in the defense or settlement of any such matter. You may not settle any matter subject to this Section without Pump.fun's prior written consent if such settlement imposes any obligation, admission, or liability on Pump.fun or does not fully and unconditionally release Pump.fun from all liability. This indemnification obligation shall survive your use of the donation functionality, any termination or discontinuation of the Donate.gg integration, and any modification, suspension, or termination of this disclaimer.

11. Incorporation of Pump.fun Terms; Arbitration; Class Action Waiver; Jury Trial Waiver

In addition to this disclaimer, your access to and use of the donation functionality, the Donate.gg integration, the routing of creator fees, and any related website, mobile application, interface, feature, content, or service made available by Pump.fun shall be subject to Pump.fun's general terms of service, as may be amended from time to time (the "General Terms"), which are hereby incorporated by reference to the fullest extent permitted by applicable law. In the event of any conflict between this disclaimer and the General Terms, the General Terms shall control except to the extent this disclaimer expressly provides otherwise.

BY ACCESSING OR USING THE DONATION FUNCTIONALITY, THE DONATE.GG INTEGRATION, OR ANY RELATED SERVICE, YOU ACKNOWLEDGE AND AGREE THAT YOU HAVE READ AND UNDERSTAND THE GENERAL TERMS AND THAT, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THIS DISCLAIMER, THE DONATION FUNCTIONALITY, THE DONATE.GG INTEGRATION, THE ROUTING OF CREATOR FEES, OR ANY RELATED USE OF PUMP.FUN'S SERVICES SHALL BE SUBJECT TO ANY BINDING INDIVIDUAL ARBITRATION PROVISION SET FORTH IN THE GENERAL TERMS. YOU FURTHER ACKNOWLEDGE AND AGREE THAT, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU ARE WAIVING ANY RIGHT TO A TRIAL BY JURY AND ANY RIGHT TO PARTICIPATE IN ANY CLASS ACTION, CLASS ARBITRATION, COLLECTIVE ACTION, PRIVATE ATTORNEY GENERAL ACTION, OR OTHER REPRESENTATIVE PROCEEDING, AND THAT YOU MAY BRING CLAIMS ONLY IN YOUR INDIVIDUAL CAPACITY, ALL AS MORE PARTICULARLY SET FORTH IN THE GENERAL TERMS.

Without limiting the foregoing, nothing in this disclaimer shall be construed to limit the enforceability of any disclaimer of warranties, limitation of liability, dispute resolution procedure, arbitration provision, class action waiver, jury trial waiver, forum selection provision, governing law provision, or any other term contained in the General Terms that may apply to your access to or use of the donation functionality or any related Pump.fun services.

12. Modifications

Pump.fun reserves the right, in its sole discretion, to modify, amend, supplement, replace, or update this disclaimer, in whole or in part, at any time and from time to time, with or without prior notice, except to the extent notice is required by applicable law. Any such modification may become effective immediately upon posting, publication, or otherwise making the revised disclaimer available through the Pump.fun website, mobile applications, or any related interface, unless a different effective date is expressly stated.

Your access to or use of the donation functionality, the Donate.gg integration, the routing of creator fees, or any related Pump.fun service after the effective date of any modification constitutes your acknowledgment and acceptance of the revised disclaimer to the fullest extent permitted by applicable law. If you do not agree to any modified disclaimer, you must cease accessing and using the donation functionality and any related features or services.

Pump.fun may, at any time and without liability, modify, suspend, restrict, disable, discontinue, or remove any aspect of the donation functionality, the Donate.gg integration, or any related content, feature, or service, whether temporarily or permanently, with or without notice. Pump.fun shall not be responsible for any loss, damage, liability, cost, or expense arising out of or relating to any such modification, suspension, discontinuation, or removal.

For the avoidance of doubt, each version of this disclaimer shall apply as of its stated "Last updated" date or other stated effective date, and any rights of Pump.fun, disclaimers, limitations of liability, indemnities, dispute resolution provisions, and other protections set forth herein shall survive any modification or termination of this disclaimer to the fullest extent permitted by applicable law.
